Assignment Title: Technical Advisor for Operationalisation of the Insolvency Law

The Government of Lesotho has received credit from the International Development Association (IDA) of the World Bank to implement the Lesotho Competitiveness and Financial Inclusion (CAFI) Project and intends to apply part of the proceeds for consulting services.

The Ministry of Trade, Industry and Business Development through the CAFI Project Management Unit (PMU), now invites interested individuals to indicate their interest in the position. Interested individuals should provide information demonstrating that they have the required qualifications and relevant experience for the position.

The selection criteria will be based on the following information, inter alia:

• Degree in Commercial Law, Insolvency Law, Accounting, Management, or a closely related field.
• A minimum of 8 years of relevant professional experience in the following areas: Insolvency practice and case management.
• Insolvency regulatory development and/or law reform.
• Work within an insolvency practitioner regulator or equivalent or closely related legal/regulatory institution.
• Proven experience in handling or managing insolvency cases, including engagement with liquidators, practitioners, creditors, and courts.
• Demonstrated experience in drafting insolvency legislation or regulations is highly desirable.
• Demonstrated expertise in legislative drafting, including preparation of primary and subsidiary legislation, regulations, and legal instruments.
• Strong knowledge of international good practice of insolvency frameworks, including the regulation of insolvency practitioners as well as corporate and natural persons insolvency frameworks, restructuring, liquidation, and business rescue systems.
• Excellent legal drafting and analytical skills, with the ability to translate policy and legal requirements into clear and enforceable regulations.
• Strong problem-solving skills and ability to provide practical solutions in complex legal and administrative environments.
• Excellent communication and stakeholder engagement skills, including facilitation of consultations and technical discussions.

The attention of interested Candidates is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers “February 2025 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. The Consultant will be selected in accordance with the Individual Consultant Selection method set out in Procurement Regulations.
